Leave to remain doesn't match BRP expiry

Post by Mat28590 » Fri Jul 02, 2021 8:40 am

My wife is currently residing with me in the UK on a spouse visa. The letter that came with the BRP said she had 30 months leave to remain from 31st January 2019, which I calculate as 31st July 2021. But her BRP expires on 28th August 2021.

As I understand it, she can submit the renewal FLR(M) application 28 days before the current visa expires. I'm not sure if her current expires 28th August, and so the earliest we can submit is 1st of August, or if the current expires 31st July, and so we can submit now.

Please help, when is the first and last dates by which we can submit?

Thanks in advance.

Its august. An extra month is added on at the beginning (I think this is 3 months now) to give her time to get here. Even if she gets here before, this isn't affected.

Ok thanks. It's a bit strange though because she was already here on a student visa and switched to FLR(M) in 2019.

This is incorrect. No extra is added to a spouse entry clearance visa.

You may be confusing it with the period of the vignette to effect travel to the UK but that doesn't add any extra time to the length of the visa.

Good thing I never said the additional time is part of the spouse visa then isn't it?
